Changes Coming to ACA for Employers in 2022

Employers will contribute less toward their employees’ health coverage in 2022 due to the Affordable Care Act’s (ACA) affordability cap of 9.61% , down from 2021’s cap of 9.83%. This percentage, set by the Internal Revenue Service (IRS), establishes employers’ health insurance contribution costs for employees.  

Beginning January 1, 2022, all health plans offered by employers must be no more than 9.61% of an employee’s household income for employer-sponsored self-only coverage to be ACA affordable. If you offer health insurance to your ACA full-time employees and the contribution amount is greater than 9.61% of their household income, you could be subject to penalties from the IRS under the healthcare law’s employer mandate. For the 2022 tax year, the penalty per employee offered unaffordable coverage is $343.33 a month or $4,120 annually.  

Who Should File  

If you have more than 50 full-time employees, are a federal contractor, or if you are an employer who is self-insured, you will need to submit 1095-C and 1094-C forms to the IRS. Employers are required to complete these forms to communicate the benefits of the plan to eligible employees.  

Filing Requirements  

Currently, employers are not required to file their 1095 and 1094 forms electronically unless they are submitting at least 250 of the forms to the IRS. However, the IRS is proposing two significant changes to electronic filing requirements. Employers will need to e-file 1095 and 1094 forms. The new IRS proposal would drop the number of forms from 250 to 100 in 2022 and from 100 to 10 in 2023. Plus, it’s expected that nearly all employers will be required to e-file tax forms by 2023. The deadline for distributing 1095 forms to employees is January 31, 2022. The deadline for filing with the IRS is March 31, 2022.  


ACA open enrollment is extended by 30 days to January 15, 2022. Open enrollment for the federal exchanges began November 1.
