A Friendly Reminder About Sexual Harassment Training

NYS has mandated you as an employer to annually provide "Sexual Harassment Prevention Training"

Originally, the date for completion was October 31st.  The State has extended the deadline for completion this year to December 31st.  As a reminder, some high level items to be aware of:

  • Sexual Harassment Prevention Policy: Every New York employer must maintain a specific written sexual harassment prevention policy meeting certain requirements.

  • Sexual Harassment Training: Employers must provide employees with qualified sexual harassment training on an annual basis.

  • Settlement of Sexual Harassment Claims: Employers can no longer require employees to agree to arbitrate sexual harassment claims. Also, non-disclosure agreements are no longer enforceable as part of a sexual harassment claim settlement agreement, unless it is the complainant's preference to have the terms remain confidential.
